Terms and Conditions
1.Pool or spa must be registered with your local council.
2.Bookings and Payment to be made through website.
No Inspection can be performed unless payment has being received.
3.Council regulation letter stating construction date and relevant Standard to be forwarded by e-mail at time of booking.
4.Property owner or representative are required on Inspection Day. A reminder will be sent by SMS.
5.Cancelation notice required 48hrs prior to inspection day. Inspection will be re allocated to next available appointment.
6.If compliant, a Certificate of Compliance will be issued within 48 hrs of inspection for you to lodge with your council. This certificate is valid for 30 days only.
7.If non- compliant and cannot be rectified on the day of inspection a notice will be issued within 48 hrs stating areas that require attention to achieve compliance.
8.A re- inspection must be completed within 60 days of receiving this notice and if all items have been addressed, then a Certificate of Compliance will be issued within 48hrs.
9.Photos will be taken as part of barrier inspections and will be included in reports.
10.The Property owner will provide access to the site, including inside if it forms part of the pool/spa barrier that will allow the Inspector to carrying out their functions.
11. A visual inspection (which may include photographic evidence) of adjoining properties for climbable objects in the immediate vicinity of boundary fences, where boundary fences are relied upon as a component of the pool or spa safety barrier.
12.It is the Property Owner’s responsibility to notify and obtain consent from their respective neighboring property owners prior to a inspection, if a boundary forms part of the barrier.
13. All pets to be secured during inspection.
14.Where the Safety Barrier poses a significant and immediate risk to life and safety, an Inspector may determine that a Certificate of Non-Compliance must be immediately issued to the Local Council which governs the Site in accordance with the Relevant Legal Requirements without the provision of additional time for the Property Owner to make repairs to the Safety Barrier.
Immediate issue of Certificate of Barrier Non-Compliance (CBNC) (Reg 147ZF)
The swimming pool inspector must issue a CBNC, if:
- the barrier poses a significant or immediate risk to life and safety.
- if the barrier cannot be made compliant within 60 days, or the owner is unlikely to bring the barrier into compliance: or
- the barrier does not comply with the applicable barrier standard in the following ways:
- the door or gate when in the closed position, can be opened by a person who is unable to reach the opening mechanism for that door or gate; or
- the door or gate cannot be completely closed; or
- the barrier is less than 1000mm in height measured above the ground level on the approach side.
15. By booking any Inspection, you acknowledge to receipt of and agree to these terms and conditions.
